Özet:

The historical accumulation we have regarding fiqh works sheds light on the lives of todays people and helps them to understand and live the religion better. The views found in these works are sometimes strong enough to be called ijma and are preferred by people, and sometimes they are weak enough to be called chaz and are not preferred by people. In fiqh works, the concept of shaz is sometimes used to express views that oppose the ijma, and sometimes this concept is used to express views that oppose the opinion of the majority ulema. The fact that absolute views are not known and preferred by people does not make them worthless; each view has been put forward by experts on the subject who have devoted their lives to this science, and is based on a number of strong evidence, sometimes mental and sometimes narrated. This seminar consists of two parts, and the first part focuses on the concept of shaz and draws attention to the meaning of this concept in fiqh. In the second part, the Shaz jurisprudence books have discussed the Shaz opinions and their bases on the issues related to prayer, fasting, zakat and hajj matters related to worship. In the concluding section, it is concluded that these views have some strong grounds, even if they are shazas, and that every view of the ulema is based on a scholarly approach.
